These conditions govern access to and use of Polk County Criminal History. Viewing a page, reading its content, or submitting a search means the visitor agrees to the terms below. Anyone who does not agree must stop using the site.

NO FCRA USE. This is a privately operated website with no government affiliation. Neither the site nor its advertising partners offer a consumer reporting service for credit, employment, tenant, insurance, or another purpose regulated by the Fair Credit Reporting Act. The site only organizes Polk County and North Carolina record resources. It is neither a private investigation firm nor a consumer reporting agency.

1. What This Website Is

Polk County Criminal History is an independent reference resource. It does not possess official criminal files and cannot obtain a record, conduct an official check, or submit paperwork for a visitor.

Its content points to the Polk County Sheriff, North Carolina courts, the North Carolina State Bureau of Investigation, and the North Carolina Sex Offender and Public Protection Registry. It may also connect readers with outside research tools.

2. Rules for Using This Site

By using the site, a visitor agrees not to:

  • Violate a federal, North Carolina, or local law
  • Threaten, stalk, harass, or intimidate another person
  • Use content for an FCRA-regulated decision
  • Attempt unauthorized entry into a site system
  • Operate bots, scraping software, or automated collection tools against the pages
  • Interfere with performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

Information obtained here or from a linked source must not be used to harass, stalk, threaten, intimidate, or discriminate. The rule is especially important for North Carolina Sex Offender and Public Protection Registry data. SBI warns that threats, intimidation, stalking, or harassment based on registry information can lead to criminal prosecution. Registry access serves public safety awareness, not private punishment or exclusion.

4. We Are Not a Consumer Reporting Agency

This site is not a consumer reporting agency under the FCRA and produces no credit report, background report, or consumer report. Its content and partner tools may not be used to:

  • Make an employment decision
  • Evaluate a renter or housing application
  • Assess credit or insurance eligibility
  • Decide access to a license, permit, or public benefit
  • Carry out any other action governed by the FCRA

A person needing a legally compliant report for a regulated purpose must use an authorized, FCRA-compliant source. The North Carolina SBI provides a fingerprint Right to Review for a person's own state record, not a public screening product.

5. No Legal Advice

Information here is general reference material, not legal advice. It cannot determine how a Polk County charge, warrant, conviction, or North Carolina expunction law applies to a particular person. That requires a licensed North Carolina attorney.

6. No Warranties

The site and its content are supplied "as is." We do not warrant that:

  • Every detail is complete, correct, or current
  • Access will remain uninterrupted
  • Every page is free from defects or security risk
  • A partner's search result is complete or properly matched

Criminal record status can change through new filings, dispositions, corrections, restrictions, or expunction. Nothing here is an official statement from the Polk County Sheriff, a court, the North Carolina SBI, or another agency.

7. Third-Party Services and Links

The site links to official agencies, courts, legal resources, and outside search providers. A destination controls its own content, price, availability, terms, and data practices. We are not responsible for those operations. Review the destination's terms before using it.

8. Intellectual Property

Text, design elements, graphics, logos, and code belong to Polk County Criminal History or its content partners. They may not be copied, changed, distributed, or used to make a derivative work without prior written permission.

9. Limits on Our Liability

To the maximum extent allowed by law, we are not liable for loss or damage tied to use of the site, reliance on its content, or use of a linked service.

10. Indemnification

A visitor agrees to defend and hold us harmless from claims, demands, proceedings, fees, and costs arising from that visitor's use of the site or violation of these terms.

11. Governing Law

North Carolina law governs these terms. Any dispute concerning use of the site must be brought in a court located in North Carolina. Public access to government records is separately governed by the North Carolina Public Records Law and its exceptions.

12. Changes to These Terms

We may revise these terms. A revision takes effect when the updated terms appear on this page.

13. Cutting Off Access

We may restrict or end a visitor's access at any time, for any reason, and without advance notice.

14. Severability

If a court finds one provision invalid or unenforceable, the other provisions remain effective. The affected term is adjusted only as far as needed to make it enforceable.
